Dwayne Barrett is a Member of Reno & Cavanaugh with a broad range of transactional experience on issues relating to affordable housing and Federal and state tax issues, including: low-income tax credit developments, GO Zone tax credits, tax-exempt bond financing, tax increment financing, AHP Funds, CDBG funds, HOME funds, and mixed finance transactions.  His experience also includes drafting state legislation, structuring numerous joint ventures, and appeals of property tax matters.
 
Selected Recent Transactions

 

  • Represented numerous developers and investors in the syndication of losses associated with projects financed in part with ARRA Section 1602 grant funds.
  • Lead team of attorneys that closed 46 gap financing projects out of a statewide total of 84 projects in Tennessee.
  • Represented a large housing authority and affiliated nonprofit organization in the acquisition of controlling interests in several low-income housing tax credit developments using HOME and CDBG funds along with an applicable PILOT program
  • Prepared legislation that exempted developments utilizing low-income housing credits from the Tennessee franchise and excise tax
  • Represented a developer in the acquisition of four affordable housing developments with tax-exempt bonds enhanced with a RD 538-insured loan and subordinated RD 515 loans and 4% Low-Income Housing Tax Credits.
  • Closed numerous LIHTC projects in the Go Zone that were subsidized with CDBG Loans
